§ 10-78. Prohibition of activities during a burn ban.

  • (a)

    The outdoor burning of yard trash, bonfires, campfires, warning fires, and cooking fires within Osceola County, during a burn ban, is prohibited unless:

    (1)

    Authorized by the Florida Division of Forestry; or

    (2)

    Cooking of food exclusively within a contained gas or charcoal grill.

    (b)

    Subject to the following exceptions, the sale or discharge of a firework by any person or entity within Osceola County, during a burn ban, is hereby prohibited for the purpose of preventing wildfires during drought conditions.

    (1)

    Pursuant to Florida Statutes, the use of fireworks for agricultural works or operation of a fish hatchery is governed entirely by the rules prescribed by the Department of Agriculture and Consumer Services. Accordingly, the prohibition against discharge of a firework shall not apply to persons in full compliance with requirements of the Florida Administrative Code, governing the use of firecrackers in agricultural works and fish hatcheries.

    (2)

    The fireworks ban shall not include the sale or use of hand-held sparklers.

    (3)

    The fireworks ban shall not include a public fireworks display done by a licensed contractor who has completed the county permitting process under the Osceola County Code.
