§ 13-119. Definitions.

The following words, terms and phrases shall have the meanings as stated, except where the context clearly indicates a different meaning:

Copper means the nonferrous metal known as copper, and includes, but is not limited to, copper, copper alloy, copper utility service wire, and copper communications service wire.

Ferrous metals means any metals containing significant quantities of iron or steel.

Fixed location means any site occupied by a secondary metals recycler as owner of the site or as lessee of the site under a lease or other rental agreement providing for occupation of the site by the secondary metals recycler for a total duration of not less than three hundred sixty-four (364) days.

Money means a medium of exchange authorized or adopted by a domestic or foreign government as part of its currency.

Nonferrous metals means metals not containing significant quantities of iron or steel, including, without limitation, copper, brass, aluminum, bronze, lead, zinc, nickel, and alloys thereof, excluding precious metals subject to regulation under F.S Part I, Chapter 538, except that automotive catalytic converters or similar devices containing any recoverable quantity of platinum shall be included in this category.

Personal identification card means any government issued photographic identification card.

Purchase transaction means a transaction in which a secondary metals recycler gives consideration (e.g., money, payment) for regulated metals property.

Reasonable proof means a bill of sale or other document of a type customarily relied upon in the ordinary course of business to establish that a seller is either the lawful owner or an authorized seller of the regulated metals property.

Regulated metals property means any item composed primarily of any nonferrous metals, including copper, but does not include aluminum beverage containers, used beverage containers, or similar containers. For purposes of enforcement under this ordinance, the term shall include stainless steel beer kegs, as well as all items specifically listed as restricted regulated metals property herein.

Restricted regulated metals property means any regulated metals property, whether whole or in parts, that are listed in section 13-121 of this article, the sale of which is restricted herein.

Secondary metals recycler shall have the meaning ascribed in F.S. § 538.18, as may be amended from time to time.

Seller means the person from whom the regulated metal property is acquired. If the regulated metals property is acquired by the secondary metals recycler through an authorized employee/agent of a business entity, then the term "seller" refers to the business entity.

Utility means any person, firm, corporation, association, or political subdivision, whether private, municipal, county, or cooperative, which is engaged in the sale, generation, provision, or delivery of gas, electricity, heat, water, oil, sewer service, telephone service, telegraph service, radio service, television service or telecommunication service.
