§ 13-131. Record of purchases, sales required—Precious metals dealers.

  • (a)

    Each precious metals dealer as defined in F.S. § 538.01 shall maintain for a period of one (1) year following any purchase of precious metal the following records of such purchase:

    (1)

    The full name; residence address; home telephone number, if any; place of employment; business telephone number, if any; and age, race, and sex of each person from whom the precious metal is purchased, the records including the signature of the seller, together with the driver's license number or the number from another form of identification issued by a governmental agency, one (1) other identifying number, and a thumbprint of the seller.

    (2)

    A specific description of the precious metal item, which description is accurate and as reasonably complete as the nature of the item permits. The description of the precious metal item shall include:

    a.

    The type of item;

    b.

    The substance of which the item is made, whether gold, silver, or platinum;

    c.

    The manufacturing company, if that can be determined; and

    d.

    Any permanent initialing or marking on the item, including a brand, monogram, or hallmark.

    (3)

    The quantity of the precious metal purchased.

    (4)

    The date of the purchase.

    (5)

    The amount paid by the dealer for the item.

    (b)

    A copy of the records of any purchase of precious metal shall be submitted within twenty-four (24) hours after the purchase to the sheriff and to the municipal police department of the municipality in which the business is operated.
