§ 13-133. Order stopping sale, etc., of property.

  • Upon developing probable cause to believe the property in the possession of any person regulated by this division is stolen, a law enforcement officer shall have the right, in lieu of seizure, to issue a written order to a particular dealer or other person regulated hereunder, to stop the sale, removal or redelivery of any property for up to sixty (60) days unless earlier released by such officer in writing. At the end of sixty (60) days, the hold order shall expire and the dealer or other person may dispose of the subject property in any lawful manner. After receipt of such an order, it shall be unlawful for any dealer or other regulated person to sell, dispose of, remove or redeliver such property, until the property is released by the officer issuing the order.
