§ 14-160. Purpose and intent.

  • The purpose of this article is to establish requirements that regulate medical marijuana treatment centers in the interest of the public health, safety and general welfare and that ease the regulatory burden on the county. In particular, this article is intended to regulate the sale and distribution of cannabis to ensure a supply of cannabis to patients who qualify to obtain, possess, and use cannabis, pursuant to state law, while promoting compliance with other state laws that regulate cannabis. Nothing in this article shall prohibit a medical marijuana treatment center, or another entity licensed under state law to dispense cannabis, from making deliveries of cannabis or derivative products to the residence or business of an authorized individual, or to a health care facility, as permitted by other relevant ordinances and state law. Nothing in this article is intended to promote or condone the sale, distribution, possession, or use of cannabis in violation of any applicable state or federal law. Compliance with the requirements of this article shall not provide a defense to criminal prosecution under any applicable law.
