§ 14-135. Sales or leases at NeoCity.

  • (a)

    The county manager, district manager or such person's designee shall publish a notice in substantially the following form no less than once a year in the newspaper for which the county or such dependent special district of the county has contracted to publish legal notices.

    "PLEASE TAKE NOTICE that Osceola County [Dependent Special District] hereby offers for sell or lease, on a continual basis, various parcels of real property owned by the County [Dependent Special District] in NeoCity, a 483-acre technology district located south of E. Irlo Bronson Memorial Highway across from Osceola Heritage Park, for development consistent with the purposes described in the NeoCity Master Plan dated June 12, 2017. Persons offering to purchase or lease property in NeoCity must demonstrate that the proposed use of the property will stimulate economic growth within the County by growing high-wage and high-value added employment opportunities, and especially by promoting economic diversification, high-technology research and innovation, and fostering a vibrant advanced sensor and other advanced manufacturing industry in the County. Terms of any sale or lease will depend on the location and quantity of real property and other factors, including the economic benefit to be derived by the County [Dependent Special District] from the proposed use of the property, and are subject to review and approval by the Board of County Commissioners [Governing Board of Dependent Special District]. Use of property sold or leased is subject to covenants, conditions and restrictions applicable to the particular property; and standard or negotiated sale or lease terms approved by the County [Dependent Special District].

    Parties interested in entering into negotiations for purchase or lease of particular parcels should contact the Osceola County Manager, 1 Courthouse Square, Suite 4700, Kissimmee, FL 34741, Phone: (407) 742-2385, Fax: (407) 742-3291. [This paragraph shall include current address and communication information for the responsible individual, as amended from time to time.]

    Should any party and the County [Dependent Special District] agree to the terms of any proposed sale or lease, the proposed sale or lease agreement will be scheduled for recommended approval by the Board of County Commissioners [Dependent Special District Governing Board]. All persons registered with the County Manager [District Manager], as described below, will receive emailed notice of the meeting date. Any other person wishing to submit an offer on the particular parcel(s) upon which a recommended sale or lease has been submitted to the Board must propose in writing, and deliver to the County Manager [District Manager], sale or lease and use terms which are more advantageous to the County [Dependent Special District] before the date and time set by Board agenda for action on the recommended sale or lease under consideration.

    If the Board timely receives multiple offers for sale or lease for the same parcel(s) of land, then the Board, in its sole legislative discretion, will determine which offer for sale or lease, if any, is the most advantageous to the County [Dependent Special District]. The Board of County Commissioners [Dependent Special District Governing Board] further reserves the right to reject any and all offer(s) for sale or lease upon determination that such offer(s) is (are) not in the best interests of the County [Dependent Special District] as determined solely in the exercise of the legislative discretion vested in the Board under the Constitution and laws of the State of Florida.

    Interested persons who wish to register their names and email addresses to be advised of Board agendas which include sales or leases of property at NeoCity should contact the County Manager [District Manager]."

    (b)

    Procedures for sale or lease of real property within NeoCity shall be as described in the foregoing notice or section 14-134.

    (c)

    Notices published prior to the effective date hereof that comply with the provisions of the foregoing subsection (a) shall satisfy the requirements of this section.
