§ 16-55. Regulation of airboats on certain bodies of water.

  • (a)

    Geographical boundaries. The provisions of this section shall apply only to the operation of an airboat on East Lake Tohopekaliga and West Lake Tohopekaliga, located within the boundaries of Osceola County, as defined in F.S. § 7.49.

    (b)

    Hours of operation. No person shall operate an airboat between the hours of 11:00 p.m. and 5:00 a.m., except as provided in subsection (c) of this section.

    (c)

    Exemptions.

    (1)

    Nothing in this section shall, at any time, prohibit the use of a federal, state, or county airboat properly operated in the line of duty, by duly authorized personnel.

    (2)

    Nothing in this section shall prohibit the use of an airboat properly operated by a licensed nuisance alligator trapper, officially commissioned to trap, catch, or kill a nuisance alligator. As used in this section, the term "licensed nuisance alligator trapper" shall be an individual licensed by the Fish and Wildlife Conservation Commission pursuant to rule 68A-25.003, Florida Administrative Code.

    (d)

    Enforcement. Violations of this section shall be noncriminal infractions and shall be enforced in accordance with F.S. § 327.73, and as amended.
