§ 17-176. Imposition.

(a)

All residential construction occurring within the unincorporated area of the county shall pay the park impact fees, established in accordance with this division at the time of issuance of a certificate of occupancy.

(b)

The commission hereby establishes one (1) countywide park district for countywide parks for purposes of collection and expenditure of the park impact fee for countywide parks. The commission hereby establishes five (5) sub-county park districts for community parks and recreational facilities, as provided in Appendix B, for the purposes of collection and expenditure of the park impact fee for community parks and recreational facilities.

(c)

The park impact fees rates for countywide parks, community parks and recreational facilities shall be established by a separate resolution of the county adopted before July 1, 2006. Thereafter the annual indexing procedure set forth in section 17-177 shall be applied.
