§ 18-102. Abandonment.

(a)

In the event an individual newsrack remains empty, of publications, for a period of twenty (20) days, same shall be deemed abandoned and may be treated, in accordance with section 18-103.

(b)

At least eighty-five (85) percent of the compartments contained in a modular newsrack shall be occupied at all times. Any modular newsrack failing to maintain the eighty-five (85) percent occupancy requirement for over twenty (20) days, shall be deemed abandoned and may be treated in accordance with section 18-103. If the modular newsrack is placed by a modular newsrack provider and the eighty-five (85) percent occupancy requirement is not maintained for over twenty (20) days, said modular newsrack provider may be considered in breach of its agreement with the county, thereby enabling the county to seek any and all remedies available under said agreement.
