§ 19-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Abandoned property means wrecked or derelict property having no value other than nominal salvage value, if any, and which has been left abandoned and unprotected from the elements and shall include inoperative or partially dismantled motor vehicles, trailers, boats, machinery, refrigerators, washing machines, plumbing fixtures, furniture, and other similar articles.

    Annual assessment resolution means the resolution described in section 19-68 hereof, establishing the rate at which a solid waste service assessment and/or household chemical waste service assessment for a specific fiscal year will be computed. The final assessment resolution shall constitute the annual assessment resolution for the initial fiscal year in which a solid waste service assessment is imposed or reimposed.

    Approved bag means a waterproof plastic trash bag of at least four-ply composition.

    Assessable property means (i) with respect to solid waste collection and disposal services, tax parcels in the urban service area and the rural service area on which residential service units are located, and rural parcels located in the urban service area on which dwelling units are located, and (ii) with respect to household chemical waste services, any tax parcel in the county on which dwelling units are located.

    Assessment roll means the special assessment roll relating to a solid waste service assessment approved by a final assessment resolution pursuant to section 19-66 hereof or an annual assessment resolution pursuant to section 19-68 hereof.

    Biological waste means solid waste that causes or has the capability of causing disease or infection and includes, but is not limited to, biomedical waste, diseased or dead animals, and other wastes capable of transmitting pathogens to humans or animals. The term biological waste does not include human remains that are disposed of by persons licensed under F.S. ch. 470.

    Biomedical waste means any solid waste or liquid residue which may present a threat of infection to humans. The term biomedical waste includes, but it not limited to, non-liquid human tissue and body parts; laboratory and veterinary waste which contain human-disease-causing agents; discarded disposable sharps; human blood, and human blood products and body fluids; and other materials which in the opinion of the Florida Department of Health represent a significant risk of infection to persons outside the generating facility. The term biomedical waste does not include human remains that are disposed of by persons licensed under F.S. ch. 470.

    Board means the county's board of commissioners.

    Buenaventura Lakes special service area means the portion of Buenaventura Lakes depicted in appendix A.

    Building means any structure, whether temporary or permanent, built for support, shelter or enclosure of persons, chattel, or property of any kind. This term shall include mobile homes or any vehicles serving in any way the function of a building.

    Bulk items means items that exceed three (3) cubic yards in volume and require special handling and management, e.g., large household goods or furniture, and items remaining after occupants move out or are evicted. Bulk items must be usual to housekeeping and previously used by the customer at the dwelling unit for which collection service is provided. The term bulk items excludes exempt waste and white goods.

    Bundle means a package containing yard trash only, weighing fifty (50) pounds or less, and not exceeding four (4) feet in its longest dimension or six (6) inches in diameter; tied with cord or rope, or otherwise secured in a manner to permit lifting and carrying of the full weight thereof without spillage or leakage.

    C&D bag means a fabric container sufficiently strong to transport transporting construction and demolition debris, that has been approved by the county solid waste director for such purpose. A fabric container eight (8) feet two (2) inches long by four (4) feet two (2) inches wide by two (2) feet six (6) inches tall, holding three (3) cubic yards/six hundred six (606) gallons of debris and strong enough to hold 3.300 pounds is hereby deemed to meet the foregoing standard.

    Certificate of occupancy means the written certification issued by the county that a building is ready for occupancy for its intended use. For the purposes of this chapter, a set up or tie down permit or its equivalent issued for a mobile home shall be considered a certificate of occupancy.

    Collector means a commercial solid waste franchisee or a person or corporation contracting with the county for the collection of solid waste from residential property.

    Commercial container means a dumpster, compactor, roll-off or other portable nonabsorbent water-resistant container that is used to store not less than two (2) cubic yards of solid waste and is designed to be emptied by mechanical means, which has a water-resistant lid or cover if used for the disposal of garbage.

    Commercial property means all improved property other than residential property.

    Commercial solid waste means solid waste generated by commercial property.

    Construction and demolition debris means discarded materials generally considered to be not water soluble and nonhazardous in nature, including but not limited to steel, glass, brick, concrete, asphalt material, pipe, gypsum wallboard, and lumber, from the construction or destruction of a structure as part of a construction or demolition project or from the renovation of a structure, including such debris from construction of structures at a site remote from the construction or demolition project site. The term includes rocks, soils, tree remains, trees, and other vegetative matter which normally results from land clearing or land development operations for a construction project; clean cardboard, paper, plastic, wood, and metal scraps from a construction project; except as provided in F.S. § 403.707(12)(j), unpainted, nontreated wood scraps from facilities manufacturing materials used for construction of structures or their components and unpainted, nontreated wood pallets provided the wood scraps and pallets are separated from other solid waste where generated and the generator of such wood scraps or pallets implements reasonable practices of the generating industry to minimize the commingling of wood scraps or pallets with other solid waste; and de minimis amounts of other nonhazardous wastes that are generated at construction or demolition projects, provided such amounts are consistent with best management practices of the construction and demolition industries. Mixing of construction and demolition debris with other types of solid waste will cause it to be classified as exempt waste.

    Contractor means any person or corporation entering into an agreement with the county for collection of residential solid waste pursuant to the terms of article III of this chapter.

    County means Osceola County, a charter county and political subdivision of the State of Florida.

    County attorney means the chief legal officer of the county, or such person's designee.

    County manager means the chief executive officer of the county, or such person's designee.

    County road system is as defined in the Florida Transportation Code.

    Curbside means a ground level location that is, in the following order of priority, (i) within three (3) feet of the curb of any road, street or alley that abuts the property on which a dwelling unit is located and which is accessible by fire and emergency vehicles, (ii) if there is no curb, within six (6) feet of the paved surface of any road, street or alley that abuts the property on which a dwelling unit is located and which is accessible by fire and emergency vehicles, (iii) within six (6) feet of the closest accessible public right-of-way, or (iv) any other location agreed to by the resident and contractor that will provide a safe and efficient location to the contractor's crew and vehicle. If an appropriate location cannot be agreed upon, the county manager shall designate the location for pickup, considering the presence of threatening or dangerous dogs or other animals.

    Curbside collection service means the removal of one or more of the following from the curbside of residential service units: residential household waste, recovered material, yard trash and white goods.

    Curbside multifamily property means commercial property for which a franchisee has been contracted to provide curbside collection service from residential containers in lieu of commercial container service.

    Drop-off service means the provision of facilities to which the occupants of residential service units can deliver residential household waste, recovered material, yard trash, white goods and household chemical waste.

    Duplex means a building that contains two (2) dwelling units.

    Dwelling unit means a building, or a portion thereof, lawfully used for residential purposes, consisting of one (1) or more rooms arranged, designed, used, or intended to be used as living quarters for one (1) family only. The term "dwelling unit" includes a mobile home.

    Excluded dwelling unit means a dwelling unit located (i) on a farm and ranch parcel, (ii) within a resort service area or (iii) within a mobile home/RV park.

    Exempt waste means biological waste, contractor generated waste, construction and demolition debris, hazardous waste, sludge, construction and demolition debris mixed with other types of solid waste, material resulting from home improvements, land clearing debris, automobiles, automobile parts, boats, boat parts, boat trailers, internal combustion engines, tires, lead acid batteries, used oil, yard trash exceeding four (4) feet in its longest dimension or six (6) inches or more in diameter or weighs more than fifty (50) pounds, or any other material that may not be disposed of lawfully in a Class I Landfill (as defined in Rule 62-701.340(3)(a), Florida Administrative Code).

    Farm and ranch parcel means a tax parcel twenty (20) acres or larger in size that is served with a commercial container.

    Final assessment resolution means the resolution described in section 19-66 hereof which shall confirm, modify, or repeal the initial assessment resolution and which shall be the final proceeding for the initial imposition of solid waste service assessments or household chemical waste service assessments.

    Fiscal year means that period commencing October 1st of each year and continuing through the next succeeding September 30th, or such other period as may be prescribed by law as the fiscal year for the county.

    Franchisee means any person or corporation granted a franchise for collection of commercial solid waste pursuant to the terms of article II of this chapter.

    Garbage means all putrescent waste which generally includes, but is not limited to, kitchen and table food waste, animal, vegetative, food or any organic waste that is attendant with, or results from the storage, preparation, cooking or handling of food material.

    Hazardous waste means any material which is defined as a "hazardous waste" by the State of Florida Department of Environmental Protection in the State of Florida Administrative Code; or by any future legislative action or; by federal, state or local law.

    Historically-assessed multifamily residence means each of the following multifamily residences, all of which have previously been assessed for solid waste service:

    Household chemical waste means and includes the following items used for residential purposes only: automotive antifreeze, solvents, batteries, oil, brake fluid and transmission fluid; spray paint, paint cans, paint thinners and wood preservatives; gardening pesticides, insect sprays or dust, weed killer, poison and insecticides; household cleaning supplies, drain cleaner, degreasers, oven cleaners, moth balls, spot removers and pool chemicals.

    Household chemical waste service cost means the amount necessary to fund the cost of household chemical waste services allocable to assessable property during a fiscal year and shall include, but not be limited to:

    (1)

    The cost, whether direct or indirect, of all services, programs or facilities provided by the county, or through contractual arrangements with the county relating to household chemical waste service;

    (2)

    The cost of any indemnity or surety bonds and premiums for insurance;

    (3)

    The cost of salaries, volunteer pay, workers' compensation insurance, or other employment benefits;

    (4)

    The cost of computer services, data processing, and communications;

    (5)

    The cost of training, travel and per diem;

    (6)

    The cost of engineering, financial, legal or other professional services;

    (7)

    All costs associated with the structure, implementation, collection, and enforcement of the household chemical waste service assessments, including any service charges of the tax collector or property appraiser;

    (8)

    All other costs and expenses necessary or incidental to the acquisition, provision, or delivery of the services, programs or facilities funded by the household chemical waste service assessment, and such other expenses as may be necessary or incidental to any related financing authorized by the board;

    (9)

    Reasonable reserves and administrative charges; and

    (10)

    Reimbursement to the county for any monies advanced for any costs incurred by the county in connection with any of the foregoing items of household chemical waste service cost.

    Household chemical waste service means drop-off service for household chemical waste.

    Household chemical waste service assessment means a special assessment lawfully imposed by the county against assessable property to fund all or any portion of the cost of the provision of household chemical waste disposal services, facilities or programs providing a special benefit to property as a consequence of possessing a logical relationship to the value, use or characteristics of the assessable property.

    Identifiable neighborhood means (i) a platted subdivision or (ii) a portion of a platted subdivision consisting of residential service units separated only by common areas, along a single residential street or multiple residential streets, the beginning and end of which can be identified easily by collection vehicle drivers.

    Improved property means all property within the county on which a building or other improvements including, but not limited to, facilities providing retail electrical service to such property have been placed or constructed, which improvements result in such property generating solid waste or being capable of generating solid waste.

    Initial assessment resolution means the resolution described in section 19-62 hereof which shall be the initial proceeding for the identification of the solid waste service cost and/or household chemical waste service cost for which an assessment is to be made and for the imposition of a solid waste service assessment and/or household chemical waste service assessment.

    Isolated duplex means an individual duplex surrounded by single-family residences.

    Mobile home means manufactured homes, trailers, campers and recreational vehicles.

    Mobile home/RV park means property lawfully used as a rental park for mobile homes that is served with a commercial container.

    Multifamily residence means a building that contains two (2) or more dwelling units.

    Owner means the person reflected as the owner of assessable property on the tax roll.

    Property appraiser means the Osceola County Property Appraiser.

    Public property means lands and improvements owned by the federal government, the state, the county or municipalities lying within the county, and includes buildings, grounds, parks, playgrounds, streets, sidewalks, parkways, rights-of-way and other similar property.

    Recovered material means metal, paper, glass, plastic, textile, rubber or other materials designated by the county that have known recycling potential, can be feasibly recycled, and have been diverted and source separated or have been removed from the solid waste stream for sale, use, or reuse as raw materials, whether or not the materials require subsequent processing or separation from each other, but does not include materials destined for any use that constitutes disposal.

    Residential container means any commonly available light gauge steel, plastic, or galvanized water tight receptacle of a non-absorbent material, closed at one end and open at the other, furnished with a closely fitted water tight removable top or lid and handle(s). A residential container shall not exceed forty-five (45) gallons in capacity, unless the county authorizes the contractor to implement an automated or semi-automated collection system requiring the use of some other standard receptacle.

    Residential household waste means garbage and rubbish generated by residential property and does not include exempt waste.

    Residential property means (i) improved property on which (a) a single-family residence, isolated duplex or mobile home has been constructed or sited, or (b) an historically-assessed multifamily residence is located, and (ii) improved property located in the Buenaventura Lakes special service area that has been assessed under subsection (b) of section 19-45 hereof.

    Residential service unit means (i) a dwelling unit located in (a) a single-family detached residence, isolated duplex or mobile home within the urban service area or the rural service area that is not an excluded dwelling unit, or (b) an historically-assessed multi-family residence, and (ii) a dwelling unit located in the Buenaventura Lakes special service area that has been assessed under subsection (b) of section 19-45 hereof.

    Resort service area means any area served by a commercial container that meets each of the following criteria:

    (1)

    An identifiable neighborhood that is either:

    a.

    Wholly located within the short-term rental overlay district identified in chapter 14 of the county's land development code, or

    b.

    Has vested rights to the uses permitted within the short-term rental overlay district that arose before the short-term rental overlay district was established;

    (2)

    Not less than eighty-five (85) percent of the dwelling units located within the area are registered with the county to collect and remit tourist development taxes; and

    (3)

    The entire area is included within a community development district or subject to a property owners association that provides on-site solid waste collection and imposes special assessments against all dwelling units to fund the cost of on-site solid waste collection.

    Rubbish means all refuse, accumulation of paper, excelsior, rags, wooden or paper boxes and containers, sweep-ups and all other accumulations of a nature other than garbage, which are usual to housekeeping; also any bottles, cans or other containers not containing garbage.

    Rural parcel means a tax parcel located in the urban service area of a size, if any, as specified in the initial assessment resolution, that is inappropriate for curbside collection service.

    Rural service area means the portion of the county designated to receive drop-off service for residential solid waste in the initial assessment resolution.

    Single-family residence means a building that contains a single dwelling unit.

    Sludge means a solid waste pollution control residual which is generated by any industrial or domestic wastewater treatment plant, water supply treatment plant, air pollution control facility, septic tank, grease trap, portable toilet or related operation, or any other such waste having similar characteristics. Sludge may be a solid, liquid, or semisolid waste but does not include the treated effluent from a wastewater treatment plant.

    Solid waste means abandoned property, biological waste, biomedical waste, bulk items, construction and demolition debris, garbage, hazardous waste, rubbish, yard trash and white goods generated by improved property.

    Solid waste service means curbside collection service or drop-off service.

    Solid waste service assessment means a special assessment lawfully imposed by the county against assessable property to fund all or any portion of the cost of the provision of (1) solid waste collection and disposal services, facilities, or programs, and/or (2) household chemical waste services, facilities or programs, providing a special benefit to property as a consequence of possessing a logical relationship to the value, use, or characteristics of the assessable property.

    Solid waste service cost means the amount necessary to fund the cost of solid waste service allocable to assessable property during a fiscal year and shall include, but not be limited to:

    (1)

    The cost, whether direct or indirect, of all services, programs or facilities provided by the county, or through contractual arrangements with the county relating to solid waste service;

    (2)

    The cost of any indemnity or surety bonds and premiums for insurance;

    (3)

    (8)

    All other costs and expenses necessary or incidental to the acquisition, provision, or delivery of the services, programs or facilities funded by the solid waste service assessment, and such other expenses as may be necessary or incidental to any related financing authorized by the board;

    (9)

    Reasonable reserves and administrative charges; and

    (10)

    Reimbursement to the county for any monies advanced for any costs incurred by the county in connection with any of the foregoing items of solid waste service cost.

    Tax collector means the Osceola County Tax Collector.

    Tax parcel means a parcel of property to which the property appraiser has assigned a distinct ad valorem property tax identification number.

    Tax roll means the real property ad valorem tax assessment roll maintained by the property appraiser for the purpose of the levy and collection of ad valorem taxes.

    Uniform assessment collection act means F.S. §§ 197.3632 and 197.3635, or any successor statutes authorizing the collection of non-ad valorem assessments on the same bill as ad valorem taxes, and any applicable regulations promulgated thereunder.

    Urban service area means the portion of the county designated to receive curbside collection service for residential household waste in the initial assessment resolution.

    White goods means discarded refrigerators, ranges, water heaters, freezers, and other similar domestic appliances that were previously used at the dwelling unit from which they are collected.

    Yard trash means vegetative matter resulting from routine and periodic yard and landscape maintenance which is less than four (4) feet in length in its longest dimension or less than four (4) inches in diameter or weighs less than fifty (50) pounds or any combination thereof. The term yard trash does not include exempt waste.
