The board reserves the right, from time to time, to prescribe additional requirements,
including, without limitation, the regulation of rates, fees and service charges no
matter how denominated, for the protection of the health, safety, welfare and convenience
of the public and to recognize changing circumstances as it is understood that the
field of solid waste collection and transportation in a rapidly growing county such
as Osceola is a dynamic process with serious and changing environmental, economic,
legal, sanitary and transportation-related ramifications. The county expressly reserves
the right to impose mandatory waste collection in all or portions of the county and/or
to adopt municipal service taxing or benefit units, special districts or other means
by which to fund such collection and to grant exclusive or nonexclusive contracts
to selected service providers to provide such service, notwithstanding the grant of
a franchise under this article. The county also expressly reserves the right to directly
engage in and deliver waste collection services by its own forces. To the extent that
existing or future state or federal law conflicts with any provisions of this article
or any franchise granted under it, the state or federal law shall prevail except to
the extent that said change in law would impair any covenants of indebtedness or other
financing arrangement incurred by the county in reliance upon this article or any
provision hereof.
