§ 20-71. Creation of municipal service benefit units.

(a)

The board is hereby authorized to create MSBUs encompassing property located within the unincorporated area of the county and such property situated within a municipality as to which consent is received by such municipality as provided in F.S. § 125.01(1)(q). Each MSBU shall encompass only that property specially benefited by the local improvement and/or local service proposed for funding from the proceeds of assessments to be imposed therein. The resolution creating each MSBU shall include brief descriptions of the proposed local improvement and/or local service, a description of the property to be included within the MSBU, and specific legislative findings that recognize the special benefit to be provided by each proposed local improvement and/or the local service thereof to property within the MSBU.

(b)

At its option, the board may establish a process pursuant to which the owners of property may petition for creation of an MSBU to fund a local improvement and/or local service. Notwithstanding any petition process established pursuant to this section, the board shall retain authority to create an MSBU without a landowner petition.
