§ 24-61. Definitions applicable to fire rescue impact fees.

  • The following words, terms, and phrases when used in this article V, chapter 24, and the accompanying resolution establishing fire rescue impact fees shall have the meaning ascribed to them in this section, except where the context clearly indicates a different meaning:

    Agriculture shall mean an establishment characterized by general active and ongoing agricultural activities, including agronomy, aquaculture, forestry, fisheries, apiculture, silviculture, and similar uses.

    Alternative fire rescue impact fee shall mean any alternative fee calculated by an applicant and approved by the impact fee Coordinator pursuant to section 24-65 of this Code.

    Alternative fire rescue impact fee study shall mean a study prepared by an applicant and submitted to the impact fee coordinator pursuant to section 24-65 of this Code.

    Church shall mean an establishment in which worship, ceremonies, rituals, and education are held. Typical uses, include but are not limited to, churches, mosques, synagogues, and temples, but shall not include day care, schools, residences, or other activities not directly related to religious practices.

    EMS impact fee shall mean the portion of the fire rescue impact fee imposed by the Board that relates to the EMS system.

    EMS system shall mean buildings, apparatus, and equipment provided by the county that is used for handling of emergency medical incidents.

    Fire protection impact fee shall mean the portion of the fire rescue impact fee imposed by the board that relates to the fire protection system.

    Fire protection system shall mean buildings, apparatus, and equipment provided by the county that is used for suppression and prevention of fires and other disasters and the handling of incidents involving hazardous materials within the county.

    Fire rescue impact fee shall mean the combined fire protection impact fee and EMS impact fee imposed by the board pursuant to section 24-63 of this Code, as it may be adjusted from time-to-time pursuant to section 24-68 of this Code.

    Fire rescue impact fee land use category shall mean those categories of land us incorporated in the fire rescue impact fee study.

    Fire rescue impact fee study shall mean the study adopted by the board in section 24-62 of this Code, as it may be amended and supplemented pursuant to section 24-67 of this Code.

    Fire rescue system shall collectively mean the EMS system and fire protection system.

    Government/public shall mean a governmental or quasi-public use, not located in a shopping center. Typical uses include, but are not limited to, fire stations, city halls, courthouses, post offices, jails, libraries, museums, military bases, airports, bus stations, and recreational buildings.

    Hospital/clinic shall mean an establishment for the care of human patients providing services to inpatients and outpatients and medical care to the sick and injured or medical centers that offer primary and urgent care treatment for all types of injuries and traumas and which may include related facilities such as laboratories, training facilities, central administration and staff facilities; provided, however, that any related facility shall be incidental and subordinate to principal hospital or clinic use and operation.

    Hotel/motel shall mean an establishment in which sleeping accommodations are offered to the public and intended primarily for rental for temporary occupancy by persons on an overnight basis.

    Industrial/warehouse shall mean an establishment primarily engaged in the fabrication, assembly, processing, manufacturing, display, storage and sale of goods to other firms for resale, activities involving significant movement and storage of products or equipment. Typical uses include, but are not limited to, manufacturing plants, welding shops, wholesale distributors, storage warehouses, moving and storage firms, trucking and shipping operations, and major mail processing centers.

    Nursing home shall mean an establishment whose primary function is to care for persons who are unable to care for themselves, including rest homes and chronic and convalescent homes.

    Office shall mean an establishment not located in a shopping center and exclusively containing establishments providing executive, management, administrative, or professional services, and which may include ancillary services for office workers, such as a restaurant, coffee shop, newspaper or candy stand, or child care facilities. Typical uses include, but are not limited to, real estate, banking, insurance, property management, investment, employment, travel, advertising, secretarial, data processing, telephone answering, telephone marketing, music, radio and television recording and broadcasting studios; professional or consulting services in the fields of law, architecture, design, engineering, accounting and similar professions; interior decorating consulting services; medical and dental offices and clinics, including veterinarian clinics and kennels; and business offices of private companies, utility companies, trade associations, unions and nonprofit organizations.

    Restaurant/bar shall mean an establishment where meals, prepared food, confections and drinks, both alcoholic and non-alcoholic, are served to customers for consumption on or off premises.

    Retail/commercial shall mean an establishment engaged in the selling or rental of goods, services, lodging or entertainment to the general public. Typical uses include, but are not limited to, shopping centers, discount stores, supermarkets, home improvement stores, building, material and lumber stores, garden centers, gasoline service stations, car dealerships, convenience markets, furniture stores, pharmacies, restaurants, bars, nightclubs, automobile sales and service, retail banking facilities, including banks, savings and loans and credit unions, movie theaters, amusement arcades, bowling alleys, golf courses open to the public, marinas, movie theaters, barber shops, laundromats, funeral homes, private vocational or technical schools, dance studios, health clubs, racquet clubs, banquet halls and conference facilities, hotels, motels and boarding houses.

    School/college shall mean an establishment that provides a curriculum of elementary or secondary academic instruction. A public school is one operated by any governmental organization for the benefit of the general public. All other schools are private schools.

    Timeshare shall mean timeshares as defined in section 24-2 of this Code; provided, however, that for purposes of the fire rescue impact fee, timeshare property shall be classified according to the type of structure. Timeshare property located in multi-unit buildings shall be designated as multi-family dwelling units. Timeshare property located in detached single family structures shall be designated as single family detached units.
