§ 2-42. Retirement contributions for officers, employees of Orange-Seminole-Osceola Transportation Authority.
(a)
Social security. The board of county commissioners shall remit only on a pro-rata basis set forth to the state division of retirement any and all contributions due and owing that division to secure social security coverage for the covered officers and employees of the Orange-Seminole-Osceola Transportation Authority, in the event that the Orange-Seminole-Osceola Transportation Authority is unable to remit those contributions. Proper notice of the amount of contributions due and owing shall consist of an itemized statement from the state division of retirement showing the wages and contributions due thereon for each covered officer and employee of the Orange-Seminole-Osceola Transportation Authority and certification by the state retirement director that the Orange-Seminole-Osceola Transportation Authority has refused or is unable to remit such contributions. Such pro-rata payment of such contributions to the division by the board of county commissioners shall in no way release the Orange-Seminole-Osceola Transportation Authority from its obligations to repay same to the board of county commissioners as stipulated by them in a separate agreement.
(b)
State retirement system. The county shall remit only on a pro-rata basis to the state retirement system trust fund its proportionate share of any and all contributions due and owing that trust fund to purchase service credit for officers and employees of the Orange-Seminole-Osceola Transportation Authority in the event that the Orange-Seminole-Osceola Transportation Authority as an employing agency of the state retirement system is unable to remit those contributions. Proper notice of the amount of contributions due and owing shall consist of an itemized statement from the state division of retirement showing the wages and contributions due thereon for each participating officer and employee of the Orange-Seminole-Osceola Transportation Authority and certification by the state retirement director that the Orange-Seminole-Osceola Transportation Authority has refused or is unable to remit such contributions. Nothing contained in this subsection shall be construed to apply to contributions due to purchase past service credit on behalf of the participating officers and employees of the Orange-Seminole-Osceola Transportation Authority unless the board of county commissioners specifically agrees in writing to assume this additional liability. Such pro-rata payment of contributions to the trust fund by the board of county commissioners shall in no way release the Orange-Seminole-Osceola Transportation Authority from its obligation to repay same to the board of county commissioners as stipulated by them in a separate agreement.
