§ 7-22. Applicable codes and ordinances.

  • (a)

    Language contained in the following ordinances which sets forth a fine amount to be imposed or states that a violation of this article is a misdemeanor punishable by law through the issuance of a citation, for a violation of any such ordinance is hereby repealed; however, all other enforcement provisions contained in said ordinances shall remain in full force and effect.

    It is hereby the intent of the board of county commissioners to repeal any fine language, contained in all codes, ordinances and/or companion resolutions, which does not clearly define the fine, or monetary penalty, to be imposed or which is inconsistent with the provisions of chapter 7, article II, supplemental enforcement procedures; code enforcement citation program, of the Osceola County Code of Ordinances. The omission of a code, ordinance or resolution number, from the above list, is unintentional and shall not alter the effectiveness of this section, on any unclear or inconsistent provisions of the omitted ordinance.

    (b)

    Language contained in the following codes, ordinances and/or companion resolutions, which sets forth a fine or penalty amount to be imposed through the issuance of a citation, shall remain in full force and effect, without regard to subsection (a) above; however, any such citations shall hereafter be issued and processed in accordance with chapter 7, article II, supplemental enforcement procedures; code enforcement citation program, of the Osceola County Code of Ordinances, or as same is or has been amended from time to time.

    (c)

    Upon adoption hereof, a two hundred fifty dollars ($250.00) fine shall be imposed for any county code or ordinance violations, for which a citation may be issued, unless the ordinance number is listed in subsection (b) above or the code, ordinance or companion resolution specifically states a different fine or monetary penalty. Notwithstanding the fine amount, all citations shall be issued and processed in accordance with chapter 7, article II, supplemental enforcement procedures; code enforcement citation program, of the Osceola County Code of Ordinances, and as same is from time to time amended. The penalty for a violation of a county ordinance which is subject to chapter 7 of the Osceola County Code of Ordinances may hereafter be amended by resolution.
