§ 8-28. Additional court costs.
Additional court costs as set forth below are established for purposes of funding the expenses involved in the operation of the civil traffic hearing officer program.
(1)
A two dollar ($2.00) additional court cost shall be assessed by the court to fund the costs of the program. The court cost shall be assessed in addition to the costs and fines applied to all civil traffic infraction citations which are paid or elect driving improvement school, excluding those cases which are dismissed, adjudicated not guilty or those cases citing vehicle safety violations under §§ 316.2935 or 316.610, Florida Statutes, in which the safety defects have been corrected and an affidavit of compliance executed by the law enforcement agency has been presented to the clerk within the thirty (30) day time period set forth under § 318.14(4), Florida Statutes. The clerk of the court shall retain ten (10) percent of this additional court cost paid in order to cover administrative processing expenses.

A five dollar ($5.00) additional court cost shall be assessed by the hearing officer to fund hearing costs. The court costs shall be assessed in addition to the costs and fines applied to all civil traffic infraction citations for which a hearing is requested, excluding those cases that are dismissed or adjudicated not guilty or those cases citing vehicle safety violations under §§ 316.2935 or 316.610, Florida Statutes, in which the safety defects have been corrected and an affidavit of compliance executed by the law enforcement agency has been presented to the clerk within the thirty-day time period set forth under § 318.14(4), Florida Statutes. The clerk of the court shall retain ten (10) percent of this additional court cost paid in order to cover administrative processing expenses.
