Article V. NEWSRACKS |
§ 18-92. Definitions.
Base shall mean a concrete pad installed or used to support a newsrack.
Compartment shall mean a space or set of divided spaces, built into a newsrack, with such space or set of divided spaces being secured by a single door which provides access to the publication, or publications, contained therein.
County shall mean Osceola County.
County manager shall mean the Osceola County Manager or a designated representative thereof.
Individual newsrack shall mean any self-service or coin-operated box, container, storage unit, or other dispenser, with only one compartment, installed, used, or maintained for display, sale or distribution of publications.
Median shall mean the portion of the right-of-way, of a divided roadway, which separates the opposing directions of vehicular traffic.
Modular newsrack shall mean a newsrack that is designed with multiple, separate, enclosed compartments to accommodate, at any one time, the display, sale or distribution of more than one, separate and distinct publication.
Modular newsrack district shall mean any geographic area, within the unincorporated areas of the county, that is designated by the board of county commissioners, as an area where the placement of modular newsracks is required. The placement of individual newsracks is not permitted within a modular newsrack district except as provided in subsection 18-93(b).
Modular newsrack provider shall mean any entity which contracts with the county to assume responsibility for the installation, maintenance and liability arising from the placement of modular newsracks in a modular newsrack district.
Newsrack shall mean both individual newsracks and modular newsracks, except where a distinction is expressly made.
Newsrack provider shall mean any person, individual, partnership, corporation, association, firm, company, organization, or any other legal entity which owns, places, or maintains a newsrack in the county.
Principle structure shall mean the primary building located on a parcel of land and shall not include accessory structures, tourist information booths, ticket booths and the like.
Public land shall mean any right-of-way, roadway, park, easement, building, or any other real property owned by the county or any other governmental entity.
Publication or publication title shall mean and include single or multiple copies of a single newspaper, periodical, advertising circular, which contains multiple pages and offers the goods and services of more than one company or individual, and any other printed material of the type, commonly distributed from newsracks throughout the United States. Use of the them, publication or publication title is not intended to differentiate between more than one edition, volume or issue of a single publication, but is intended to differentiate one publication from other publications without regard to the identity of the publisher. Each publication or publication title may be identified as separate and distinct through the title or masthead by which the publication is identified.
Right-of-way shall encompass right-of-way easement and right-of-way dedication and shall mean all that land designated, for the use of the public, for vehicular or pedestrian travel, and shall include, but not be limited to, streets, roadways, medians, bridges, sidewalks, bicycle paths, roadside drainage areas, ditches, curbs, and gutters.
Roadway shall mean that part of a right-of-way which is designated or used primarily for vehicular traffic, including any area designated for use as a bicycle lane or vehicular parking.
Sidewalk shall mean that part of a right-of-way which is designated for the use of pedestrian travel.
