§ 18-98. Insurance.

  • Every publisher who places or maintains a newsrack on public property, in the unincorporated areas of the county, shall submit a current certificate of general liability insurance to the county manager or his designee. Said insurance shall, in no event, be less than five hundred thousand dollars ($500,000.00). In the event that a claim is asserted, an award of attorney's fees must be paid separately and not taken from the face value of the policy. Liability insurance shall run continuously with the placement of any newsrack within the unincorporated portions of the county. The aforementioned insurance shall be of such form and written by such companies as are approved by the county manager or his designee and contain an endorsement obligating the insurance company to furnish the county thirty (30) days notice in advance of cancellation of the insurance. Said policy of insurance shall name the county as an additional insured. Proof of insurance must be provided to the county manager, or a designee thereof, within thirty (30) days of the effective date of this article. Failure to provide the county with a current copy of insurance coverage, in case of any change in same, or obtain new coverage, in compliance with the above stated requirements, within ten (10) working days of insurance change or lapse, shall be a violation of this article.
