§ 16-53. Rules of operation for commercially engaged motorboats.
(a)
It is unlawful and prohibited for commercially engaged motorboats, including without limitation commercially engaged personal watercraft, to operate outside the confines of the commercial portion of Lake Cecile which is depicted on exhibit "A" attached hereto and incorporated herein by this reference.
(b)
It is unlawful and prohibited for any livery or other commercial operation to rent, lease, or hire any motorboat, including without limitation personal watercraft, for operation upon the waters of Lake Cecile without first instructing its customers as to the limits of the commercial portion of Lake Cecile to which their operation is restricted, as well as all other rules of operation and hours of operation as set forth in this article.
(c)
All commercially engaged motorboats, including without limitation personal watercraft, must at all times be operated in a reasonable and prudent manner. Maneuvers which unreasonably or unnecessarily endanger life, limb, or property, including but not limited to, waving through congested vessel traffic, jumping the wake of another vessel unreasonably or unnecessarily close to such other vessel or when visibility around such other vessel is obstructed and swerving at the last possible moment to avoid collision, are unlawful and prohibited.
(d)
No livery or other commercial operation shall rent, lease, or hire a motorboat, including without limitation personal watercraft, upon the waters of Lake Cecile without first providing the customer with a form, to be prescribed by the county department of zoning and code enforcement concisely setting forth the rules and operation and hours of operation on Lake Cecile as established by this article, and having the customer acknowledge same by his/her signature. Each such form shall be maintained by the livery or other commercial operation for a period of thirty (30) calendar days from and after the event of rental, lease, or hire, and shall make such form(s) available for examination and copying to the county zoning and code enforcement department personnel and all law enforcement officers, upon request.
